Waihi Dairy Farmer Penalized for Environmental Compliance Breaches
Keith Torrens, a dairy farmer from Waihi, was recently fined NZD 39,000 due to unlawful discharges of dairy effluent. This penalty was imposed following a prosecution by the Waikato Regional Council, with the case heard in the Tauranga District Court. Judge Sheena Tepania administered the fine after Mr. Torrens pleaded guilty under the Resource Management Act.
The investigation into Mr. Torrens' farm was conducted by council compliance officers in October 2023. Earlier in the year, he had received an abatement notice for breaching dairy effluent regulations. During their inspection, the officers discovered two illegal discharges into the environment. These were identified as originating from the dairy shed and as a result of overirrigation, both posing a significant threat to groundwater contamination.
A key issue cited was the inadequate storage capacity on the farm, which necessitated effluent irrigation under unsuitable weather and soil conditions. Waikato Regional Council's Compliance Manager, Patrick Lynch, emphasized the necessity for farm owners to provide sufficient infrastructure and implement effective management practices. He remarked, "Dairy effluent systems need to be fit for purpose, robust and carefully managed to avoid environmental harm."
Mr. Torrens had reportedly acquired an effluent storage bladder several years prior but failed to install it, even after receiving an abatement notice and a formal warning for previous environmental breaches. Judge Tepania described his actions as careless, highlighting his ongoing responsibility to maintain efficient infrastructure. She noted, "As he had purchased a bladder, it makes no sense to the Court that he would not install it."
The case underscores the critical importance of compliance with environmental regulations in the dairy industry, particularly concerning effluent management. The Waikato Regional Council continues to stress the need for proactive measures to prevent potential environmental damage.
