The Legislative Assembly of Minas Gerais (ALMG) has passed a bill that prohibits the sale of rehydrated imported milk as fluid milk in the state. The approved Project of Law No. 2,160/2024, now awaits the governor's sanction to become effective. This legislation aims to prevent the reconstitution of imported powdered milk for sale in liquid form.

Industries found violating this law could face penalties including fines up to R$ 104,797 per infraction and potential suspension of their operating licenses, pending due administrative process. The measure prioritizes the use of locally produced powdered milk for reconstitution in case of a shortage of fluid milk.

The restriction does not affect powdered milk sold directly to consumers, as long as it complies with retail packaging and Anvisa labeling standards. The bill, proposed by State Deputy Maria Clara Marra (PSDB), previously passed its first reading with amendments and was reviewed by the Agricultural Committee before this final approval.

This legislative move aligns with efforts by the local dairy industry to safeguard its market. Minas Gerais is a significant player in Brazil's dairy sector, accounting for around 24% of national milk collection, producing roughly 9.8 billion liters annually, and contributing over R$ 18.1 billion to the state's economy.

During the bill's discussion, proponents highlighted its role in preserving the competitiveness of locally produced fresh milk, which is a crucial economic activity for many families in the region. The ALMG's decision coincides with broader national discussions on milk powder imports, particularly following the recognition of dumping practices by Argentina and Uruguay by Camex, which led to tariffs of up to 120% on these imports.

With the bill's approval in the second round, it concludes its legislative journey in Minas Gerais and awaits the governor's decision to be enacted into law.
