The Farmers’ Union of Wales (FUW) has raised concerns about the effectiveness of the new Fair Dealings Obligations (Milk) Regulations 2024, as recent milk price cuts have alarmed farmers. The regulations, aimed at ensuring transparency in the dairy supply chain, are being questioned in light of recent actions by processors.
Concerns Arise Over Effectiveness of Dairy Fairness Regulations Amid Price Cuts

The Farmers’ Union of Wales (FUW) has expressed apprehensions regarding the new Fair Dealings Obligations (Milk) Regulations 2024, designed to enhance transparency across the dairy supply chain. These concerns have surfaced as processors have announced significant reductions in milk prices, with cuts reaching up to 6p per litre, which has caused unease among farmers.

The regulations, effective since July last year, mandate that all dairy supply contracts include written terms, transparent pricing mechanisms, honor notice periods, and avoid unilateral changes. Enforcement authority rests with the Agricultural Supply Chain Adjudicator (ASCA), possessing the power to levy fines up to 1% of a company's turnover for violations.

Despite these measures, the FUW has highlighted potential gaps and communication deficiencies within the current framework. Brian Walters, a Carmarthenshire dairy farmer and FUW life member, noted that the abrupt price cuts appear to contradict the rules' intended purpose. He emphasized the need for better communication from processors to help suppliers plan and mitigate impacts.

Elin Jenkins, FUW Policy Officer, underscored that while market fluctuations are inevitable, improved transparency could have lessened the severity of the impact. The FUW is advocating for regulatory bodies to ensure that the rules are adequately enforced and to inform farmers of their rights and the available complaint channels.

A spokesperson from Defra reiterated the government's support for fair supply chains and transparent contracts, asserting that the new regulations are in place to ensure clarity for farmers regarding price determinations.
