Yoghurt Wars: Danone Loses Appeal Over Skyr in Ireland

A notable legal confrontation between dairy titans Yoplait and Danone has escalated in Ireland, providing a noteworthy case study for the international dairy sector. The Irish Court of Appeal has upheld an injunction against Danone's Irish subsidiary, Nutricia Ireland Ltd, preventing the sale of their Skyr yoghurt products. This legal challenge, initiated by Yoplait, accuses Danone of "passing off" its yoghurt with packaging so similar to Yoplait’s that it creates consumer confusion and unfairly capitalizes on Yoplait’s brand recognition.

The heart of the dispute lies in the packaging design of the Skyr yoghurts, a yoghurt derived from traditional Icelandic recipes. Yoplait, whose Skyr line launched in Ireland in September 2022, captured the market with over 430,000 pots sold last year. They argued that Danone's blue and white packaging with mountain designs mimicked their own branding too closely, potentially misleading consumers and violating competitive practices within Ireland's agribusiness landscape.

Justice Niamh Hyland supported this stance in her Court of Appeal determination, ruling out any substantial errors in the initial High Court decision. She acknowledged the market impact, refocusing the injunction to specifically prevent Danone from marketing their Skyr as Yoplait’s, without completely blocking similar products’ market presence. This adjustment acknowledges Danone’s right to market entry should their defense prove valid in further proceedings.
