Review of Dairy Industry Restructuring Act to Assess Fonterra Regulations

The Dairy Industry Restructuring Act (DIRA) is undergoing a statutory review, as announced by the Ministry for Primary Industries (MPI). The review was initiated by Agriculture Minister Todd McClay and will examine whether the current competition provisions regulating the dairy cooperative Fonterra remain necessary and effective.

The primary aim of the review is to evaluate if these provisions should be retained, repealed, or amended. This process is significant for the dairy sector, as it will assess the net benefits of maintaining these regulations. The report, which is a requirement of the Act, must be presented to Parliament by June 1, 2027.

Throughout the review, there will be two rounds of stakeholder consultation, ensuring that a range of perspectives within the dairy industry is considered. The terms of reference for the review have been published and are accessible on the MPI website for public viewing.

Fonterra, being a major player in New Zealand's dairy industry, is subject to these regulations to promote competition. The outcome of this review could potentially impact the operational framework within which Fonterra and other dairy entities operate.

The review process is part of the government's ongoing efforts to ensure that the regulatory environment remains conducive to both competition and growth within the dairy sector. The results of the consultation and subsequent recommendations will provide a clear direction for future regulatory adjustments.
