Yoplait Ireland Ltd has successfully secured a High Court injunction against Nutricia Ireland Ltd, the Irish arm of Danone, to halt the launch of a product allegedly mimicking Yoplait's "Skyr" yoghurt. The legal tussle centers on accusations of "passing off" due to the similarity in packaging design, which Yoplait argues could lead consumers to confuse Danone's product with their own.

This court action arises as Yoplait alleges that Danone's "Skyr Icelandic style" yoghurt bears a packaging resemblance to its own Skyr line, introduced to the market in 2022. The packaging dispute involves claims of similar color schemes, specifically a predominant "sheer blueness" with white backgrounds, potentially misleading shoppers. Mr. Justice Max Barrett, overseeing the case, agreed to the injunction based on these grounds, highlighting the indistinguishable appearance when the products are placed side by side.

Danone, through its subsidiary Nutricia, countered the claims by arguing that Yoplait failed to provide concrete evidence of consumer confusion. Despite this, the court ruled that an injunction was necessary to maintain the status quo while the full case is deliberated.
