Goiás Court Grants Temporary Debt Relief to Dairy Producers

The Tribunal de Justiça de Goiás has issued a temporary injunction that suspends the collection of debts from nine rural credit operations contracted by dairy producers with Banco do Brasil. This decision specifically benefits Isac Ferreira de Assis and Leandro Augusto de Sousa Ferreira, who own Fazenda Alegria in Silvânia, Goiás. The credits were originally intended for milk production costs, the acquisition of cattle, and the purchase of agricultural equipment.

The producers supported their request with technical documents, invoices, and sales receipts to demonstrate that their repayment capacity was temporarily hindered by external factors such as drought, falling milk prices, rising production costs, and decreased herd productivity. Despite their administrative request for debt extension being denied by the bank, the court found grounds to grant a partial judicial relief.

The 8th Civil Chamber of the Goiás Court analyzed the appeal and determined that the conditions warranted a suspension of the debt collection process. This legal measure ensures that the dairy farm can continue operations without immediate financial constraints until the court makes a final decision on the merits of the case.

Furthermore, the injunction prohibits any enforcement actions against Fazenda Alegria, safeguarding the farm's machinery and livestock from seizure, and prevents the producers from being blacklisted for credit purposes during the ongoing legal proceedings. The court's decision aligns with Brazil's Superior Court of Justice's established understanding, which allows for debt extension when temporary difficulties are proven under rural credit legislation.

While the current ruling provides immediate relief, the definitive outcome regarding the debt extension will depend on a thorough examination of each contract involved as the legal process continues. The court's intervention is primarily a protective measure to sustain dairy production until a comprehensive judgment is delivered.
