Danone's Legal Battle with Chobani Over Protein Label Claims

Danone, the French multinational company, has initiated a federal lawsuit against its American competitor, Chobani, in a Manhattan court. The lawsuit alleges that Chobani has been deliberately inflating the protein content claims on its 'Chobani 20G Protein' yogurt tubs. Danone contends that this practice gives Chobani an unfair advantage in the market, directly threatening its own high-protein brand, Oikos Pro, which is a significant player in the ultra-high-protein yogurt category.

The lawsuit underscores a broader competitive struggle to capture the lucrative consumer segment that includes users of GLP-1 weight-loss medications. According to market research by the Boston Consulting Group, these consumers are increasingly seeking high-protein foods to mitigate muscle wastage, boosting the demand for such products.

Danone's complaint specifically points to Chobani's packaging methods, which allegedly distort serving size information to mislead consumers about protein content. Chobani's CEO, Hamdi Ulukaya, has dismissed these allegations, stating that no external protein is added to their products and accusing Danone of using legal tactics to create negative publicity.

The legal dispute comes at a challenging time for Danone, as it faces pressure from investors due to declining market share in the U.S. Over the past three years, Danone's share of the U.S. yogurt market has decreased from 30.7% to 25.8%, while Chobani's market share has increased from 21% to 26% in the first quarter of the year.

Industry analysts from Barclays have noted that Danone's slow response in expanding manufacturing capacity to meet the rising demand for high-protein products has allowed competitors like Chobani to grow rapidly, with some achieving growth rates exceeding 20%.

Despite a modest 3% sales growth in Danone's Americas dairy unit in the first quarter, its stock has fallen by 15% this year. This legal confrontation highlights how major dairy companies are adapting their strategies and legal approaches to protect their interests in the high-margin functional protein market.
