The U.S. Food and Drug Administration (FDA) has taken significant steps in its deregulatory initiative, announcing the revocation or proposed revocation of 52 obsolete food Standards of Identity (SOI). These standards pertain to canned fruits, vegetables, dairy products, baked goods, macaroni products, and several other food items. This decision aligns with the Trump Administration's efforts to streamline regulations, ensuring resources are utilized effectively to benefit American consumers.

The journey to this decision began with the FDA's comprehensive review of over 250 food SOIs to ensure each remains relevant and advantageous for consumers. According to Robert F. Kennedy Jr., HHS Secretary, "I'm eliminating outdated food regulations that no longer serve the interests of American families." This initiative cuts through bureaucratic red tape and enhances transparency, eliminating regulations deemed superfluous.

Established in 1939, the original food standards aimed to promote fairness and consistency in food production. However, advancements in food science and safety, coupled with contemporary consumer protections, have rendered many of these standards unnecessary. As FDA Commissioner Marty Makary, M.D., M.P.H., mentioned, "Antiquated food standards are no longer serving to protect consumers..."

The agency has published several proposed rules, including:

  • The revocation of standards for 11 canned fruits and vegetables no longer found in U.S. markets. A companion proposed rule was also issued to ensure changes proceed if adverse comments affect the direct final rule.
  • Standards for 18 dairy products, such as certain milk, cream products, and cheeses, are under reconsideration.
  • Revocation proposals for 23 food product standards, involving bakery, macaroni, noodle products, and more.

This deregulation aligns with President Trump's Executive Order 14192, "Unleashing Prosperity Through Deregulation," seeking to alleviate regulatory burdens and provide greater transparency.
