The co-owner of "Glazed curds B.Y. Alexandrov" Yuri Izachik might be arrested under Article 179 of the Criminal Code of the Russian Federation
Izachik is on the federal and international wanted list. He faces up to ten years in prison. The lawyers explained to the agency that their client is currently being treated in the United States. He does not consider himself guilty, and calls the criminal case ‘the resolution of a corporate conflict with the involvement of law enforcement agencies.’
A month ago, Izachik appealed to the Arbitration Court of Moscow region with a request to cancel the donation agreement, under which he transferred 17% of shares in his company LLC Rostagrocomplex (part of Rostagroexport) to five top managers of the Rostagroexport group. The lawsuit, a copy of which RIA Novosti has, says that 76-year-old Izachik, who was in a serious physical and emotional state after illness and surgery, signed the donation contract in June under the influence of deception and delusion. In particular, he was informed that the company was experiencing financial difficulties and in the event of bankruptcy, he would allegedly be the only one to bear subsidiary liability for debts.
He was also promised (in exchange for shares in Rostagrocomplex) to redistribute shares in other legal entities of the group in his favor, but this was not done. At the same time, the company feels financially fine – its net profit last year exceeded 190 million rubles, and net assets are estimated at almost one billion rubles. In July, Izachik, who had 15% left, as stated in the lawsuit, "realized that he had been deceived," and issued a notary refusal of the donation.
One of the defendants, Babachenko, refused to accept the share. However, despite this, in the Unified State Register of Legal Entities, 17% of LLC Rostagrocomplex is recorded both for him and for each of the four other defendants. In the lawsuit, Izachik asked to recognize the donation agreement as invalid and apply the consequences of the invalidity of the transaction by returning 85% of the company to him.
