Fines for violation of labeling rules for legal entities reach 1 million rubles – CATD

According to the speaker, amendments to Article 15.12 of the Administrative Code of the Russian Federation are being prepared, which will come into force after December 1, 2021, which provides for administrative and criminal liability of participants in the circulation of dairy products on the market. So, for example, the sale of unlabeled goods produced after the date specified in regulatory documents, or the sale with fake labeling codes, which also occurs, the absence of registration in the Honest mark system, the sale of products without putting into circulation can cost an individual from 5 thousand to 300 thousand rubles, a legal entity - from 50 thousand to 1 million rubles, including imprisonment.

The speaker also explained in detail the scheme of actions in case of opening a new retail outlet. To do this, as he explained, it is necessary to perform five steps, which include the registration of an electronic signature, registration in the Honest mark system with the mandatory signature of the director. Next, you need to conclude contracts with the operator-CATD, which is both an electronic document management operator and a fiscal data operator.

The services of the electronic document management operator will be required since September 2022, when the electronic document will become mandatory.

‘This process is new and it is better not to delay it,’ the head emphasized. ‘It is better to start it a few months in advance and calmly prepare for all the requirements in order to enter this stage in September without failures and problems and not disrupt deliveries.’

You will also need to "edit" the costs of the fiscal data operator and that's why. Receipts from online sales registers are transmitted to the Federal Tax Service through the fiscal data operator. If online sales registers have already been used, then, most likely, the operator is connected. 

‘There is one point I want to focus on,’ he said. ‘Check with your operator whether data transmission to the labeling system is enabled by default in the tariff plan under which you will be served.’

The last two stages are updating the technical solutions of the circulation participant, because even if he has already traded some products, for example, cigarettes, the format of dairy products is different. Moreover, the "old" equipment may not be suitable or additional settings will be required. Therefore, you will need to contact the supplier of cash register and accounting equipment.

‘Reading codes must be provided with a special scanner that is able to read DataMatrix codes,’ said the expert. ‘They differ from linear barcodes applied to all products. Older scanner models may theoretically not support working with these types of codes. To check this, you need to go to the Honest mark website to the "Scanner check" section, get a neutral DataMatrix code to scan it and find out if your scanner is working or not.
